Theinitiativecanbeatruly"gamechanging"proposalprovideditisabletofostertrustandconfidenceamongmemberstates.Theinitiativeshouldgobeyondbilateralprojecttransactionstopromoteregionalandmultilateralpolicyframeworksandsustainability.ItistruethattheinitiativewillgeneratemutualbenefitsforChinaanditspartners.However,theeconomic,socialandenvironmentalcostsandbenefitsvaryacrosscorridors,dependingontheterrain,stateofdevelopment,productivecapacitiesandtrafficflows.Researchhasshownthatinitiativecorridorswillentailhigherbenefitsifpartnercountrieslowercrossbordertransactioncostsandimporttariffs.Forinstancea30percentdeclineinbothofthesewouldgenerateeconomicgainsof1.8percentgrowthinGDPforChinaandanywherefrom5.3to16.9percentGDPforotherparticipatingmembercountries.Improvingthequalityofinfrastructureincountrieswithlessefficienttraderegimesandborderadministrationmayresultinonlylimitedexportgains.Ouranalysissuggeststhata1percentimprovementintradefacilitationprocedures,qualityoftransportinfrastructureandinformationandcommunicationtechnologywilldeliver1.5,0.7and1.4percentincreasesinexports,respectively.Gainsarehigherforcorridorswheretradeagreementsmayalreadyexist.Withnearlytwo-thirdsofinitiativecountriesfacingenergydeficits,theinitiativeneedstocomplementandsupplementthesubregionalenergyconnectivityinitiatives.Thereismuchscopetodeveloppowergrids,promotesmart,greenandintegratedpowerandgasmarkets,harnesscross-bordergasandoilpipelinesfromresourcerichCentralAsiatoSouthandEastAsia.DrawingontheinitiativesoftheStateGridCorporationofChinaandtheGlobalEnergyInterconnectionDevelopmentCooperationOrganizationtopromoteglobalenergyinterconnectionscanenhancetheregion"senergysecurityandadvancesustainableenergyaccess.ItisalsoevidentthatICThastobeanessentialfoundationfortheinitiativeasitcanharnesscrosssectoralsynergies.E-resilienceofICTcanbeenhancedthroughincreasingdiversifiedandredundantfiberopticcables,raisingbandwidth,developingnationalICTinfrastructure,andloweringfixed-broadbandpricesasapercentageofpercapitagrossnationalincome.Theseactionscanhelpdevelopuniformqualityofservicesbetweenendpointswhichwillfacilitatetrafficdelivery,ensurelowtransitcosts,andefficientInternettrafficmanagementusingInternetexchangepoints.Whilethesocialbenefitsofsomecorridorsarehigh,thereisneedtoadoptmoreinclusiveapproachestocopewithsocialrisks.Forexample,connectingtheinitiativetoremoteareaswithnewmulti-countrycorridorswouldenableruralindustrializationandhelpnarrowurban-ruralgaps.ItisthereforeimportantthatsynergiesandcomplementaritiesbetweentheobjectivesoftheinitiativeandtheSDGscanhelpcreateawin-winsolution,particularlyasregionalcooperationandintegrationwillfacilitaterealizationoftransboundarygoals.Theinitiativewithitsunprecedentedambitionandscaleentailsenormouscomplexitiesandchallenges;however,itoffersphenomenalopportunitiestoputAsiaonawell-balancedgrowthandsustainabledevelopmentpath.Theauthorisanunder-secretary-generaloftheUnitedNationsandtheexecutivesecretaryoftheEconomicandSocialCommissionforAsiaandthePacific.Currentlyonafour-nationtourofEurope,JapanesePrimeMinisterShinzoAbeisseekingthesupportofEuropeancountriesinhisbidtogettheSouthChinaSeadisputesontheagendafortheG7summit,tobeheldinItalyinMay.GiventhatneitherJapannoranyEuropeancountriesaredirectlyinvolvedinthemaritimedisputesintheSouthChinaSea,Abeisshowinghisdesiretomeddleintheissueforhisownends.ThisisnotthefirsttimethatAbehastriedtohijacktheG7agendaandsoughttointernationalizetheSouthChinaSeadisputestoservehisulteriorpoliticalpurposes.AbehasbeenrelentlesslypushingtogetJapandeeplyinvolvedintheSouthChinaSeadisputestojustifyhiscountry"sbiggermilitarypresenceintheinternationalarena.DaysbeforeAbeembarkedonhisEuropeantour,itwasreportedthatJapanwilldispatchtheIzumo-classhelicoptercarrier,itslargestwarship,totheSouthChinaSea.The249-metervesselisduetomakestopsinSingapore,Indonesia,thePhilippinesandSriLankabeforeparticipatinginajointnavalexercisewithIndianandUSnavalvesselsintheIndianOceaninJuly.ThiswillbeJapan"sbiggestshowofnavalforceintheregionsinceWorldWarII.Foracountrythathasneversincerelyowneduptoitsmilitaristpast,suchanopenandhigh-profiledisplayofforceisitselfalarming,withoutmentioningitsintendedpurposeofmeddlinginthesovereigntydisputestowhichitisnotaparty.Japan"sinterferencecomesatatimewhentheSouthChinaSeadisputeshaveshownclearsignsofabatingthankstotherecenteffortsofthepartiesdirectlyinvolved,andwhenChinaisnegotiatingaframeworkforacodeofconductwithSoutheastAsiancountries,whichwillpavethewayforbuildingpeaceandstabilityinthewaters.Abe"smeddlingintheissue,atthisimportantstage,laysbarehisintentionofplayinguptheissueandcreatingtroubleforChina.Andhewillnodoubtwanttokeephypinguptheissuetodistracttheattentionofthoseathomefromthelandscandalinwhichheandhiswifehavebecomeembroiled.YetwhileitmaysuitAbetoplayuptheSouthChinaSeaissue,heshouldbeawarethemorehedoes,themorepeopleintheregionwillnotdeemJapantobearesponsiblecountry,animageJapanhastoestablishinthefirstplaceifitwantstobetreatedasanormalcountry.RidersscanofobikesinXi"an,Shaanxiprovince.Thebike-hirestartupisexperimentingwithadepositwaiversystemforusersinShanghaiandmayextendtheservicetoothercitiesinthecountry.[Photo/ChinaDaily]INWHATISBELIEVEDTOBEthecountry"sfirstcourtcaseagainstacompanyofferingashared-bicycleservice,a31-year-oldBeijingcitizenissuingOfo,oneofthecountry"sleadingbike-sharingcompanies,asheclaimsthathewasinjuredduetoafaultybikeherentedtwomonthsago,GuangzhouDailycommentedonTuesday:TheplaintiffclaimsthatOfoisresponsibleforinsufficientmaintenance,asheallegesthebrakesonthebikehehiredwerefaulty.Heisclaiming20,000yuan($2,900)ascompensationtocoverhismedicaltreatment,mentaldistressandtransportationcosts.Heisnotthefirstridertosolicitcompensationfrombike-sharingoperatorsinthecountryonthegroundsthatthebikestheyusedwerenotwellmaintained.Albeitmostclaimants"requestswereansweredandproperlydealtwithbythecompaniesconcerned,aroutineapproachtosituationslikethisisstillmissing.Accidentsinvolvingsharingbikes,whichhavebecomeverypopularinlessthanayear,willinevitablyincreaseasmorepeopleusethem.Thatwarrantsatailoredaccountabilitymechanismwhenitcomestotherespectiveresponsibilitiesofbothusersandthebike-sharingserviceproviders.Thebusinessmodelofstation-lessbikesisdesignedtohelpurbancommuterstravelthe"lastmile"moreefficiently.Toprotectusers"legalinterests,ensuringtheirbikesareinsatisfactoryconditionistheleastthebikeproviderscando.Admittedly,bigplayerssuchasMobikeandOfoarecoveredbyinsuranceandtheypledgetocompensateridersforanyinjuriesincurredwhileusingthebikes.Compensationisalsoavailableforpeopleinjuredbythoseusingthebikes.Sucheffortsarepraiseworthy,butnotenough.Theyshouldbeinstitutionalizedandstreamlinedinthewayinsuranceiscompulsoryforallvehicles.Bike-sharingserviceproviders,too,needlegalprotectionbecausetheyareatriskofbeingblackmailedbyunscrupuloususerswillingtogotogreatlengthstobecompensated.ThelatesthandovercomesamidtensionsfollowingSeoul"sdecisiontoinstalltheUS"TerminalHighAltitudeAreaDefenseanti-missilesystem,whichBeijingisfirmlyopposedto,andshouldserveasawake-upcalltothenewROKgovernmentthatthehard-wonBeijing-Seoulpartnershipmustevolveonthebasisoflearningfrompastmistakesratherthanrepeatingthem.ChinaandtheROKestablisheddiplomaticrelationsin1992,buryingtheirpost-KoreanWar"confrontation"thatlastednearlyfourdecades.Sincethen,thetwocountrieshaveenjoyedmorethantwodecadesofreciprocalexchangesandinteractionsuntilWashingtonandSeouldecidedtodeploytheTHAADontheROKsoillastyear,escalatingtensionsinNortheastAsia.TheremainsoftheChinesePeople"sVolunteerArmyareareminderofthecrueltyoftheKoreanWar.Atotalofaround197,000Chinesesoldiers,whofoughtintheKoreanWaragainsttheUS-ledforces,sacrificedandmostofthemwereburiedontheKoreanPeninsula,accordingtoreports.Butthepost-warlosseshavegonebeyondcasualties.Thewarwreakedhavoconlocalresourcesandresidents,dividingtheKoreanPeninsulaintotwocountriesthatarevehementlyopposedtoeachother.Peaceinitiativeshaveachievedlimitedprogressafterthe1953armisticeforalackoftrust.ThedefensetreatysignedbyWashingtonandSeoulallowstheUnitedStatesmilitarytobestationedintheROK,pushingtheDemocraticPeople"sRepublicofKoreafurtherawayfromthenegotiationtable.ThatChinaandtheROKmanagedtoupgradetheirrelationstoasatisfactorylevelinjustovertwodecades,ontheotherhand,highlightstheimportanceofstability.Thetwocountriessignedafreetradeagreementtwoyearsago,andChinahasbecometheROK"slargesttradingpartnerandexportdestination.Bytheendoflastyear,ChineseinvestmentintheROKhadalmostdoubledfromfiveyearsago.Culturalandgrassrootsexchanges,too,increasedsignificantlyoverthepastfewyears.ThecomplementarynatureoftheChineseandROKeconomieshasnotonlybroughtbenefitstothetwopeoples,butalsocontributedtoregionalstability.Andthankstotheirrespectforeachother"ssecurityconcernsandadherencetonegotiationsinhandlingtheKoreanPeninsulaissue,BeijingandSeoulforgedastrategicpartnership.ButSeoulrelinquishedthestrategicbalanceapproach;itagreedtodeployTHAADattheriskofestrangingitselffromBeijing,evenprovokingawarinNortheastAsia.TheROKdecision-makers,betheyfromthetransitionalteamorthenewadministrationtobeelectedinMay,shouldnotethatsanctioningtheDPRKhasnotstoppeditfromdevelopingnuclearweapons.GiventhattheUSadministrationunderPresidentDonaldTrumpmaybepreparingtotakeharshermeasures,itisaratherriskymoveforSeoultoexpeditetheinstallationofTHAAD,whichmanyevenintheROKareagainst.Besides,resortingtotheUSanti-missilebatteryfor"self-defense"istechnicallyquestionable,andriskssabotagingthestrategicinterestsofChinaandRussia.ThatishardlywhattheROKwantsfromit.TheauthorisanassociateresearcherattheNortheastAsiaStudiesInstituteatJilinAcademyofSocialSciences.YetonSunday,somevisitorstotheparkphotographedmembersofafamilygettingofftheircar,notoncebuttwiceinsidethepark.Witnessessaythefamilyincludedatleastonecouple,aseniorcitizenandtwochildren.Attheinterventionoftheguards,theygotbackintothecarbutonlytogetoffagainandbeingforcedtogetintotheircarasecondtime.AlthoughtheparkannouncedonMondaythatitcanprotectvisitorsfromanyattackbecausetheanimalsaresegregated,thefamily"smovewasstilldangerousasthesecuritysystemisnot100percentfoolproof.What"sworse,theyinviteddangersasvisitorswerebannedfromgettingoffcarsonroadsforfearoftrafficaccidents.Theincidentsparkedfiercediscussionsonline,andmanynetizenscomparedittotwopreviousincidents.OnJuly23lastyear,awomansurnamedZhaowhogotoffhercarintheBadalingWildlifeParkwasdraggedawaybyatiger.Shewasmauledandseriouslyinjuredbythetiger,andhermotherdiedtryingtosaveher.OnJan19thisyear,amanclimbedoverawalltoenterthetigers"enclaveinYoungorZooinNingbo,EastChina"sZhejiangprovince.Themanwaskilledbythetigers,andoneofthetigerswasshotdeadduringtheoperationtorescuehim.Intheprevioustwotragedies,manypeoplesurprisinglydidn"tshowsympathyfortherule-breakers.Andthosenetizensthatcriticizedtherule-breakerssayingtherule-breakersdeservetobepunishedsparkedheateddebates.It"stime,however,thatChinesepeoplekeptinmindtheimportanceofobeyingrules.Whatmanypeopleforgetisthefactthatrule-breakersareanunnecessaryburdenonsociety.Topreventpeoplefromrepeatingthefatalmistakesofthevisitorsofsomevisitors,thewildlifeparkhastopostinnumerableguardsalongtheroads,whichinturnincreasesthepriceoftickets.Inotherwords,ordinaryvisitorshavetopayforthewrongdoingsofafewrule-breakers.Infact,manyadministrativemovesarenecessitatedtopreventafewfrombreakingrules.Mostpeoplepayforthemetroridestheytake.Still,everyonehastogothroughticket-checkingmachinesbecauseafewdonotpaythefare.Thismeansallpassengershavetopayfortheticket-checkingmachinesjustbecausesomecommutersbreaktherules.AftertheTempleofHeavenParkinBeijingstartedprovidingfreetissuepapersinitspublictoiletsaweekago,somemediareportssaidsomevisitorswereseentakinglargenumbersoftissuepapers.Todealwiththeproblem,theparkinstalledamachineinallthetoiletsinsidetheparkovertheweekend,andeveryonehastopassavideotesttogetacertainnumberoftissuepapers.Eveninthiscase,rule-breakers,whoarefewinnumber,haveincreasedthefinancialandsocialcostforall.Onlywhentherelatedauthoritiesdeviseamechanismtocompeltherule-breakerstopayfortheincreaseinmaintenanceandsecuritycostscantheyhelppeoplebetterunderstandtheimportanceofobeyingrules.TheauthorisawriterwithChinaDaily.zhangzhouxiang@chinadaily.com.cn

  中国网财经记者还注意到,美图公司最近两个交易日的振幅分别达42.5%和18.65%,上述券商分析师表示,在港股市场上,出现巨大振幅的公司以市值低于50亿元的小公司或者遭遇做空机构做空的公司为主,类似美图公司这样市值超过500亿元还出现如此大的振幅的案例很少出现。  此前连涨11天市值超600亿内地资金成推手  至于美图公司股价连续两天高台跳水的原因,市场众说纷纭。有投资者在接受中国网财经记者采访时表示:“此前美图公司已连涨了11天,目前属于正常调整,无需恐慌”,也有投资者认为该公司“目前亏损的业绩无法支撑其超过600亿港元的市值,股价疯涨之后泡沫最终将走向破裂”。  中国网财经记者注意到,在美图公司股价上演“过山车”之前,其实已经连续11天上涨,区间累计涨幅高达80.54%,而刺激其股价上涨的原因,则主要是“被纳入了港股通标的”。  有分析人士表示:“美图其实是被中国内地资金炒起来的,因为在被纳入港股通标的前,该股日涨幅最大的也不过8%,刚刚上市时甚至多日处于破发状态。

  据了解,这十大案例的主要内容有:1.工作履历造假,用人单位试用期内解除获支持;2.劳动者未申请休年休假,不等同于放弃年休假补偿;3.合法合理调整工作岗位和地点,不属于未按约定提供劳动条件;4.培训期间付工资,不应计入培训费用;5.隐瞒利益冲突进行利益输送,用人单位解除合法;6.多次催告未返岗事后方才提交病假条,旷工解除理由可成立;7.竞业限制生效条款附期限,限制劳动者权益属无效;8.及时开具离职证明,用人单位不应设置前提条件;9.外国人就业同样须参保,签有双边或多边协议方可免除;10.违约金条款须遵守,聘用合同与劳动合同有差异。

  其中,有关休年假的案例引发关注。 给出的案例是孔某于2012年3月1日入职某互联网公司,双方订立了为期5年的劳动合同。 2017年2月28日,劳动合同到期,互联网公司通知不与孔某续订劳动合同。 在办理离职手续并领取终止劳动合同经济补偿时,孔某提出,2015年至2017年期间,因工作繁忙,其未能休带薪年休假,故要求互联网公司支付相应的补偿。

互联网公司认为,孔某因自身原因未提出休年休假,按照公司员工手册的规定,每年12月31日之前未提出休年休假的,属于自动放弃当年年休假,故公司无需支付补偿。 因双方发生争议,孔某向仲裁委提出仲裁申请,要求互联网公司支付未休年休假的工资报酬。

  仲裁委审理后认为,互联网公司的员工手册中虽规定每年12月31日之前未提出休年休假的,属于自动放弃当年年休假,但并无证据表明孔某曾书面提出因个人原因不休年休假,且上述员工手册中的规定也违反了《职工带薪年休假条例》的相关规定,故裁决支持孔某的仲裁请求。   据了解,《企业职工带薪年休假实施办法》第九条规定:用人单位根据生产、工作的具体情况,并考虑职工本人意愿,统筹安排年休假。 用人单位确因工作需要不能安排职工年休假或者跨1个年度安排年休假的,应征得职工本人同意。

第十条第二款规定:用人单位安排职工休年休假,但是职工因本人原因且书面提出不休年休假的,用人单位可以只支付其正常工作期间的工资收入。 从上述规定可以看出,年休假应由用人单位统筹安排,且在劳动者本人同意的情况下可跨1个年度安排。

本案中,孔某虽未提出休年休假,但并未书面提出因个人原因不休年休假,互联网公司虽然在员工手册中有相关规定,但该规定与法律规定相违背,故不具有相应的效力,互联网公司仍应支付相应的补偿。 文/北京青年报记者解丽。
